You agree that by accessing Oncuff Websites and / or purchasing web design services (custom services, templates, etc.) of Oncuff Websites that you have read, understood, and agree to be bound by all of these Terms and Conditions. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.
Given that we provide digital products and services, we are unable to provide refunds.
For custom design services, a non refundable, 50% of the negotiated price deposit is required upon agreement of the work. Work will not begin until the deposit is paid. The remainder of the deposit is to be paid upon completion of the work.
At this current moment, we only provide website services for Google Sites, a service offered by Google with every Google Account. All of our templates and custom services are for Google Sites and Google Sites only. Our templates will not work with Squarespace, Wix, or other website services.
Purchasing a template entitles you to the use of the template for one website on your own Google Account or that of a client’s. You cannot distribute original or modified versions of a template by Oncuff Websites to users who did not purchase the template. Bear in mind we are a small business run by a fine artist whose goal is to drastically and fairly reduce the cost of websites to other (often financially struggling) fine artists. Our service only survives if you fairly support us.
Purchasing any template (Artwork, Portfolio, etc.) from Oncuff’s Website entitles you to the following:
Creation of one Google Site website for you or a client
Personal use of the template
Commercial use is permitted only in the case of the user selling goods or services through their website for profit
Modification of colours, fonts, style, overall appearance, and text of the template to fit your needs.
You are not permitted to:
Sell, redistribute, modify, lease, license, or sub-license the original template or a modified version of the template.
Share a single license with multiple users.
Claim copyright over our templates and the images and text contained within templates. Thus, you are not permitted to claim ownership or sell the content of our templates. As per usual copyright law, you can make a derivative work (a second version of the original that is distinctly different enough to become an original). This derivative work can then be sold - not the original work I sold you.
We take on no liability for how customers choose to use our templates. You are bound to our Terms of Service as well as Google’s Terms of Service because we provide services for Google Sites which is part of Google Suite.
We are not partners with Google in any official capacity. We are a small business independently offering templates for Google Sites, an existing service within Google’s ecosystem. Oncuff Websites has no control over Google’s policies.
In using Google Sites, you are bound to Google’s Terms of Service including but not limited to no sexually explicit material or graphic violence and gore. Notably, Google does “allow nudity for educational, documentary, scientific, or artistic purposes.”
We recommend caution to artists working with so called “taboo” materials; if a major public gallery would have issues with the artwork, chances are Google might too. Google runs Arts & Culture, a service documenting a number of museum collections worldwide. Oncuff Websites recommends that you use Google Arts and Culture’s content as a best practice guideline for the content you display on your website.
Oncuff Websites does not provide a warranty or guarantee with our products. In general, we will do our best to help you with your website through our tutorials, guides, and email support. Should you require assistance beyond these supports, you can contact us about custom design services.
Oncuff Websites seeks to fairly use, compensate, and credit artists for their work wherever possible. We try our best to provide direct accreditation to the original source on the web page the content is displayed on but cannot guarantee accuracy in every case. Should any issue regarding Copyright arise, please contact oncuffwebsites@gmail.com and we will do our best to resolve them.
For our public domain works, we tend to source images from the MET’s Open Access archive, Look and Learn, as well as from other museum collections.
On Oncuff’s website, images, text, and content are copyright to Oncuff Websites or have permission for use.
Within Sample Portfolios, images, text, and other content present are copyright to their respective owners. We usually use public domain artworks that are over 100 years old to avoid potential conflicts. We usually provide a link to the collection the work is from on the web page the content is displayed on, but cannot guarantee their presence and “health” (i.e. dead links). Should you wish to use an artwork seen in a sample portfolio, you do not need to seek our permission, it should be within the public domain unless specified otherwise.
Within Template Portfolios, images, text, and other content present are copyright to Oncuff Websites.
